Casino blog sites report that William Hill has lost its appeal against the trademark infringement case brought against it by rival 32Red.
After releasing a casino called 32Vegas, the online casino games giant was taken to court by 32Red for infringement of the ‘32Red’ and ‘32’ trademarks. 32Red has built its brand around the number, offering a £32 casino bonus also styling themselves as Red32. The trial took place in October 2010, and the High Court found in favour of 32Red.
William Hill appealed this decision, launching a case that the Court of Appeal described as ‘a full-scale, wide-ranging attack on the Judge’s analysis and conclusions on virtually every aspect of his judgment’. The hearing took place over two days and was dismissed.
The CEO of 32Red stated that: ‘Quite correctly, the Court of Appeal’s judgment also supported the view that taking advantage of a well known brand such as 32Red is not acceptable’ and said that the online casino games company is ‘delighted’ with the result. A spokesperson for William Hill said that it was ‘disappointed’ with the judgement, but would like to ‘move on and concentrate on its ongoing businesses’, as the company stopped using the brand 32Vegas mid-2009.
Casino blog sites report that William Hill has been ordered to pay £70,000 for costs associated with the appeal. The full amount for the damages has yet to be determined.
